Terms of Use

These Terms of Use (“Terms”) govern your access to and use of UpStep (the “Service”), available at https://upstep.me.

By accessing or using UpStep, you agree to be bound by these Terms and by the Privacy Policy. If you do not agree, you must not use the Service.

UpStep is operated by Elnur Jabarov, an individual entrepreneur registered in the Republic of Azerbaijan.

1. Nature of the Service

UpStep provides productivity-related, community-driven content, including Steps, Reasons, Challenges, and related tools intended to support reflection, learning, and habit-building.

Important:
UpStep is not a medical, psychological, financial, or professional advisory service.

2. No Warranties & Disclaimer of Responsibility

2.1 “As Is” Service

UpStep is provided “as is” and “as available”, without warranties of any kind, including but not limited to:

  • Accuracy
  • Completeness
  • Reliability
  • Availability
  • Fitness for a particular purpose

While we strive to keep the content accurate and up to date and to operate the Service reliably, we do not guarantee that the Service or its content will be uninterrupted, error-free, fully accurate, or free of harmful components.

2.2 User Responsibility

  • All content on UpStep is for informational and educational purposes only
  • You are solely responsible for:
    • How you interpret content
    • Decisions you make
    • Actions you take based on content

UpStep explicitly disclaims responsibility for any outcomes, losses, or damages resulting from user decisions or actions based on Steps, advice, or other content.

3. User Accounts

  • Account creation is required to access private features
  • Authentication is handled via email and password
  • You are responsible for:
    • Maintaining account security
    • All activity under your account

4. User Content & Moderation

4.1 Content Rules

You must not submit content that is:

  • Illegal or unlawful
  • Hate speech or discriminatory
  • Spam or misleading
  • Sexually explicit or adult-oriented
  • Gambling-related
  • Harmful, dangerous, or encouraging unsafe behavior
  • Not suitable for users under the age of 13

4.2 Moderation & User Feedback

  • All public content is subject to moderation
  • While we moderate content, we do not guarantee that all content is free from error or discomfort
  • Users may flag content they find disturbing or inappropriate
  • We may remove or modify content based on moderation or user feedback, at our discretion

5. Suggestions & Public Contributions

When you submit suggestions (including Steps, Reasons, Challenges, or Tags):

  • You grant UpStep a non-exclusive, perpetual, worldwide, royalty-free license to:
    • Use
    • Display
    • Modify
    • Adapt
    • Merge
    • Remove such content
  • Submission does not guarantee approval or publication
  • UpStep may edit, partially use, or delete suggestions at any time

Ownership and handling of suggestions are further detailed in the Privacy Policy.

6. Intellectual Property

  • UpStep owns all rights to:
    • The platform
    • Design
    • User interface
    • Branding
    • Logos
    • Code
  • You may not copy, modify, distribute, reverse-engineer, or exploit any part of the Service without prior written permission

7. Acceptable Use & Restrictions

You agree not to:

  • Scrape, crawl, or automatically extract data
  • Resell or commercially exploit content without permission
  • Interfere with system integrity or security
  • Attempt unauthorized access to accounts or infrastructure

UpStep is intended for personal use only unless explicitly authorized.

8. Commercial Features & Pricing

  • UpStep reserves the right to:
    • Introduce paid features
    • Modify pricing
    • Restrict previously free features
  • Existing users may be notified by email about pricing or feature changes
  • Future users may receive changes without prior notification

9. Account Suspension & Termination

UpStep reserves the right to, at its sole discretion:

  • Suspend or terminate accounts
  • Restrict specific actions (e.g., suggestions) while allowing limited access
  • Act without prior notice in case of violations

Reasons may include (but are not limited to):

  • Violations of these Terms
  • Harmful behavior
  • Abuse of the platform

10. Termination by User

  • You may request account and private data deletion at any time
  • Requests must currently be made via email:

Self-service deletion may be introduced in the future.

11. Service Availability

UpStep may:

  • Perform maintenance
  • Experience downtime
  • Modify or discontinue features

We are not liable for any resulting inconvenience, data loss, or damages.

12. Limitation of Liability

To the maximum extent permitted by law:

  • UpStep shall not be liable for indirect, incidental, or consequential damages
  • Total liability shall not exceed the amount you paid to UpStep (if any) in the previous 12 months

13. Governing Law

These Terms are governed by and interpreted in accordance with the laws of the Republic of Azerbaijan, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time.

Users will be notified via:

  • Website notice
  • Email (when applicable)

Continued use of the Service constitutes acceptance of updated Terms.
